CLEAR ACCESS. SHARED RESPONSIBILITY.
Terms of service
These terms govern access to Inspired Pulse, a private marketing reporting and client communication application operated by INSPIRED MARKETING & DESIGN, LLC (“Inspired,” “we,” “us”).
Effective September 26, 2026 · Questions: support@inspiredmarketing.design
1. Acceptance and related agreements
By accessing or using Inspired Pulse, you agree to these terms and our Privacy Policy. If you use the service for a business, you represent that you are authorized to accept these terms for that business. If you do not agree, do not use the service.
Inspired Pulse supports services provided by Inspired. A proposal, statement of work, subscription, or other client agreement may contain additional terms about scope, fees, deliverables, ownership, confidentiality, or termination. If those terms conflict with these terms, the signed client agreement controls for the conflicting subject.
2. Authorized access and accounts
Inspired Pulse is available only to invited clients, authorized agency staff, and other approved users. Access is personal to the invited email address. You must provide accurate account information, protect sign-in links and devices, and promptly notify us of suspected unauthorized access.
You may view only the client workspaces and internal functions assigned to your account. Client users may not attempt to access another client’s information. Staff roles and administrative permissions are limited according to the access level assigned by Inspired. We may suspend or remove access when authorization ends, security is at risk, or these terms are violated.
3. Reporting, source data, and AI assistance
Reports are assembled from configured third-party platforms, warehouses, imports, and account settings. Coverage, comparison periods, definitions, attribution, freshness, and availability can differ by source. Source corrections, outages, delayed synchronization, tracking changes, duplicate outcomes, and configuration choices can affect results. Reports should be read with their displayed dates, evidence, and limitations.
Optional AI features help retrieve, calculate, organize, compare, and present supported reporting information. AI does not replace source data, professional judgment, or human review, and it can produce incomplete or incorrect output. AI features do not independently change advertising campaigns, budgets, business profiles, or source records. Users remain responsible for reviewing outputs before relying on or sharing them.
Reporting and AI output is provided for business information and planning. It is not legal, tax, accounting, financial, medical, or other regulated professional advice, and it does not guarantee leads, revenue, rankings, advertising performance, or any other business result.
4. Acceptable use
You agree not to misuse the service or help anyone else do so. Prohibited conduct includes attempting to bypass access controls; accessing data without authorization; probing, disrupting, reverse engineering, scraping, or overloading the service; introducing malicious code; using reports or personal data unlawfully; impersonating another person; or using the service to violate third-party rights or applicable law.
Authorized users may download, copy, and share client-facing reports and approved communications for the relevant client’s legitimate business purposes. Private team notes, internal workflows, credentials, system configuration, and information belonging to another client may not be disclosed outside their authorized audience.
5. Client information and feedback
You retain your rights in information you or your authorized providers supply. You grant Inspired the limited permission needed to host, process, display, analyze, and transmit that information to operate, secure, support, and improve the service and perform our client work. You represent that you have the authority to connect accounts, submit information, and authorize the processing you request.
If you provide product suggestions or feedback, we may use them without restriction or compensation, provided we do not publicly identify you or disclose confidential client information without permission.
6. Our service and intellectual property
Inspired Pulse, including its software, design, workflows, branding, documentation, and non-client-specific materials, is owned by Inspired or its licensors and is protected by applicable intellectual property laws. These terms provide a limited, revocable, non-transferable right to use the service for its intended purpose; they do not transfer ownership of the service.
We may update, add, restrict, or discontinue features as the service evolves. We will use reasonable care to avoid unnecessary disruption and will communicate material changes when appropriate.
7. Third-party services
The service depends on third parties such as Google, Supabase, Vercel, OpenAI, Plausible Analytics, Meta, Keyword.com, Jepto, Resend, Elfsight, and other configured providers. Their services, availability, data, and terms are outside our control. Connecting or opening a third-party service may also be subject to that provider’s terms and privacy practices.
Your use of Google-connected features must comply with applicable Google terms and policies. You may revoke a Google OAuth connection through your Google Account or remove business and advertising account permissions through the relevant Google product. See our Privacy Policy for how Inspired Pulse handles connected Google information.
8. Availability, suspension, and termination
We aim to keep Inspired Pulse reliable, but the service may occasionally be unavailable for maintenance, provider outages, security work, or circumstances beyond our control. We may suspend access to protect users, clients, data, or the service; comply with law; address nonpayment under a client agreement; or investigate misuse.
You may stop using the service at any time. Ending access does not automatically delete records that must be retained for security, legal, contractual, backup, or legitimate business purposes. Data requests are handled as described in the Privacy Policy.
9. Disclaimers and limitation of liability
To the fullest extent permitted by law, Inspired Pulse is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation. Nothing in these terms excludes rights or warranties that cannot legally be excluded.
To the fullest extent permitted by law, Inspired and its owners, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the service. Inspired’s aggregate liability arising from Inspired Pulse will not exceed the amount paid to Inspired for the service during the six months before the event giving rise to the claim, unless applicable law requires otherwise.
10. Governing law and changes
These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Subject to any dispute process in a signed client agreement, disputes relating to these terms or Inspired Pulse will be brought in the state or federal courts serving Maricopa County, Arizona, and the parties consent to their jurisdiction.
We may update these terms as the service or legal requirements change. The effective date above identifies the current version. Material changes will be communicated as appropriate. Continued use after updated terms take effect constitutes acceptance of the revised terms.
